SUBJECT : Incorrect Full and Final settlement.

1) On 17th Febuary 2009, I applied for an annual leave from 18th July 2009 to 30th August 2009.
2) Based on your approval of that leave, I booked a return ticket to me and my family to India and back.
3) But on 7th August 2009, you decided to force me to accept an incorrect proforma full and final settlement for AED 7, 762.00.
4) This is incorrect and not as per the rules, because,
a) I have a copy of the “Emploment contract for Sponsored Staff” of the Jabel Ali Free Zone authority, as a “Development Manager” in “Voyager Technoogies International Limited”, with a monthly salary of AED 6, 000/=. This is signed by me, counter signed by you and approved by the Jabel Ali Free Zone authority. (Valid from 27th November 2004 till 30th December 2010).
b) I have not submitted my resignation and now I have gone on normal annual leave.
c) I have the copy of the “Jafza” (Government of Dubai, Jabel Ai Free Zone), Employment card# 146255 of valid up to 11/2011 (November, 2011). The original is with you.
d) I hold a visa# 39331533 from Jabel ali free zone, valid up to 3oth December 2010.
e) I hold a UAE Idntity card # 784-1939-9306187-3 valid up to 30th December 2010.
f) You have not given 90 days notice for my service termination (clause 2b of the contract)
g) Proforma payment of AED 7, 762/= as per 3 above s hence not acceptable.

The actual acceptable amount as per rule is AED 120, 250.90 or US$ 32, 721.34 worked out as below (after deducting the proforma paymen of AED 7, 762.00, as per (3) above : -
a) Salary payable from 1st July 2009 till 30th November 2010 - AED 102, 000.00 ( 6 months in 2009 + 11 months in 2010 = 17 months at AED 6, 000/= per month)
b) Salary payable from 1st December 2010 till 30th December 2010 - AED 5, 806.45 (30 days X AED 6, 000/31 days - up to the visa ending date).
c) Leave salary – 30 days paid vacation - AED 6, 000.00
clause 8 of the contract in 4(a) above.
d) Gratuity at 7 days for each year of service - AED 5.806.45
Total service from 1st Jan 2005 to 30th Dec 2010 = 6 Years -
AED 8.400.00 clause 11 of the contract in 4(a) above
7 days X AED 6, 000/30 days X 6 years)

Net payable is One hundred and Twenty Thousand, Two hundred and fifty UAE Dirhams and Fills Ninety only. It is equivalent to Thirty two Thousand Seven hundred and Twenty one US Dollars and Cents Thirty four only, at the current exchange rate of One US$ = 3.675 AED.

Please remit US$ 32, 721.34 as above, to my PAYPAL account [email protected] within 3rd September 2009. Because, UAE Dirhams (AED) is not an acceptable currency of exchange by the banks in my location.
