Collections Abuse
My trouble with Wachovia began last February. I had purchased my vehicle with my ex and after our split I just couldn't afford to have a 535.00 a month car payment. Trying to do the right thing I asked my stepdad who is looking for a new car if he would like to assume my loan. We wanted to do it legally so we called Wachovia to find out if they had any programs to offer us. They said they had a refinance program that you can refinance the loan to a family member. We thought this would be easy as my stepdad is a Dentist and has excellent credit. Well it wasn't. Apparently in the half of a year I owned the car my 2007 Jeep depreciated 50% so they wanted my stepdad to pay the car out of debt asking 11k down. We were shocked so we had to turn down the refinance. We were advised by the underwriter to wait a year till the economy gets better and then re-try spring 2010 till then my stepdad drives the car and insures it and always pays. Occasionally he hits some late dates but never 30 days as he knows how crucial my credit is.
In April 2009, my car had become 10-15 days late. Because I had not answered my phone or returned their abusive excessive phone calls they showed up at my door. The local Albuquerque branch sent over the customer service rep to my house. I happened to be home getting ready for work and "knock knock" there is a man at my door. Not knowing who it was I opened the door slightly and the man said, "Are you Danielle." I said yes. He said "Weve been trying to contact you and you do not answer your phone". I laughed and said well how late am I. He said "10-15." I laughed and said so you feel you can come to my house. I shut the door and called my parents to see if they had mailed the payment in. My mom said she didn't know it was late but would call and pay it right away. She wanted the local branch number as she was outraged that they showed up at my residence for a car not even close to 30 days late. She paid two payments up front that day!
Today, I recieved 9 phone calls from Wachovia regarding my account being 20 days late. When Gary called me from the local branch he stated my payment was late. I let him know that I called last week on the 18th (which was a holiday) and let them know the payment was in my stack of mail waiting for pickup. He said that it wasn't good enough cause that was 11 days ago. Actually, Gary it was 7 business days ago. He demanded payment right now. I explained that I don't make the payments my parents do and it was mailed last week so look at the account notes as I even called. He said I didn't call and I needed to pay it right now. I said I don't drive the jeep so I am not making the payment. My parents payed it and he needs to wait and see if it arrives to their main office across the United States. He refused and started getting rude and loud and demanded to know where my jeep was right now. I told him it was none of his business. He stated that its their collaterol and he wants to know where it is and whose driving it. I said look at the account notes it explains everything as I am not going to go over the story again! He got loud and stated that he was repossessing my car. I said you're not repossessing it, and he said watch me. And hung up. I called back two times to try and talk to a manager and both times he hung up on me. At this point I am even more outraged as I am working and dealing with this. Finally a woman answered and told me she would transfer me. When "Kat" the manager picked up she already had my account up. Funny how that happened. Wonder if their abuse is a joke in their office that they were prepared for my call. Kat was even more abusive telling me to read my contract they can reposs after the first day late. I asked for another manager and she stated she was the only one. She stated can do whatever she wants. Don't tempt her. Watch it happen. MOre and More abuse I endured to the point that I asked if she was having a bad day since its snowing here that she feels she can be rude and act like trash. She told me she was picking my car up for repo and hung up.
After all of that I called the 1800 number and spoke to a wonderfully nice call center rep. He apologized for their abusive behavior and explained he couldn't do anything but he would freeze my account to stop the calls while we wait for the check to arrive. He then asked if he could transfer me to his manager so that a complaint could be started. I filed a complaint that the manager said would be forwarded on to his manager who would send it to Collections Manager who oversees all collections. He was apologetic. He asked for their names in the report but I didn't have them so I decided to call back and get their names. Gary answered and then transfered me to Kat. I asked her if my car was being repo'd so I could have it ready. She then denied all of it stating she never said that and that she never abused or threatened me. ( I wonder if someone was listening in) She then continued to imply I was a lier and towards the end I just said you act like a trash and hung up. I called the 1800 back and gave the names as I was calling I had "call waiting" once again it was the local office. This time it was Kile calling for a courtesy call. Apparently he was a manager. Funny how Kat told me she was the only manager. I told Kile not a good time you can call me back later. After his call Amanda called who was also a manager. Hmm another manager this is hilarious. How much can one office lie? And remember how Kat denied her abuse and threats well Amanda stated she listened to Kat's call with me. Totally makes sense how they lie and she reneged everything. Well Amanda didn't get it either. She continued to state that I am the bad guy and they are doing their job because I am late. Once again, what didn't t theyunderstand about "PAYMENT MAILED" after her conversation I said don't call me you guys are abusive and I will only deal with 1800 number. I'm sure she will ignore it and they will continue to abuse me! I can't wait till we write the payoff check next month, and my time with Wachovia will be over!
Can you believe in 36 months there has been close to 600 complaints against Wachovia Dealer Services? How much more do people have to endure before someone does a class action suit? They are abusing FDCPA with threats, excessive calls, and statesments of repo to try and get payment.

Reposession
Wachovia Dealer Services operates with the most unethical unprincipled business practices of any lending company I have ever financed with. They are inept at accounting and record keeping. I complied with all their requests for insurance verifications over the course of 5 months to only be ridiculed harassed, badgered and threatened by the robotic slimy rude imbeciles that work for them. My breakthrough moment came from a three way conversation with the collection agent from Wachovia on the phone and a Wachovia insurance department representative that flat out stated “we received the documentation but every time we call the company they put us on hold for too long so we hang up.” How this company continues to operate on the blood sweat and tears of our tax money and how their employees lay their heads on their pillows at night is beyond me.
I was in possession of a luxury vehicle and due to illness was approaching being two months behind on payments with intent to pay one lump sum within 7 days of the day I looked out my window to see the rude when confronted—spastic cocained-out belligerent threatening private recovery company tow truck driver attempting to take my vehicle away minutes before I was leaving for work.
I empathize and understand that they are a business; their apathetic sentiment should be saved for truly negligent customers that perhaps are half a year or more behind. What exactly do they hope to accomplish by repossessing people’s vehicles and selling them at auction within days. No one has money in this economy to buy cars so ultimately they are screwing themselves out of the mob interest and investment interest they have made and stand to make from seizing vehicles in which the owners are a few months behind on payments. It makes no sound business sense unless they do which I believe have deals worked with private car lot owners to buy seized cars. When does the madness stop? How do we go about banding together and setting up reasonable collection practices for these institutions?
If you are considering financing with them I beg of you to reconsider. They are despicable.

AWFUL CUSTOMER SERVICE & IMPOSSIBLE TO DEAL WITH
STAY AWAY FROM THIS COMPANY!!! This is THE MOST AWFUL company to deal with. I have made all of my payments on time for the past 2 years and just tried to request a deferral of one payment to the end of the loan. First, I need to mention that I've been trying to reach one of the morons in their Deferrment Dept. for a month now and after multiple times of holding for ONE HOUR, I finally got in touch with someone today. I explained that I need a deferral because the car has been broken down for 4 months and I'd like to get it fixed since I'm making payments on a car I can't drive. They said I have to fix the car first & then prove I used the money for that. Well, I CAN'T get the car fixed if I can't defer the payment. I don't make that much money to begin with! I then spoke to a manager and asked if there was anything else they could do to which he replied "No." I even told him that I would just eventually end up telling them to come get the car and that they would not want it, especially broken down, to which he replied "OK." I have had 4 cars financed before and NEVER had this much trouble.
Their Customer Service Reps, even Managers, are all RUDE and inconsiderate and treat you like you're dirt on the ground. Just like I told the manager today, I will NEVER finance a car with them EVER AGAIN!!!

Calss for late payments at 22 days
This company calls me when my payment gets 21 days past due last month I mailed payment in ratehr that use online service, the customer service rep on the phone tried to get me to stop payment on the check and pay over the phone, he then tried to tell me that there company policy dictated that once you go behind 30 days that have to get a method of direct debit on the account for future payments. This is a company that received TARP, and the want me to guarantee payment. When I knew I was falling on hard times I called them and tried to work something out they told “No” we cant do anything.
So now I am about 22 days behind and they keep calling, what is amazing to me is, I cant get a street address to send them a letter to stop harassing me and calling my work when I am not 30days delinquent on the bill. An in no way am I going to agree for them to direct debit my account, I guess my questions is can a company force a consumer to do this, if so I don't recall signing any finance agreement that highlighted this if so I would not have done so.

Beware and stay away
I have had 3 loans with this Company 2 Paid off in Full the 3rd became late in April 2009 my pay off was in Sept 2009 I have NEVER made a late payment and I am real tired of the rude calls, stalking and threatening I have made payments to pay off my loan I was told last week Dec 16 Pay off $174 and some change and this week December 28 I am told $305 r they out of there mind? They told me it is intrest I guess as well as are rude they can't add as they have no idea what they are talking about and the want to be managers are just as clueless. It really doesn't matter $17, 000.00 later I have my vehicle and I WILL NEVER finance through this idiot Company again I will also be filing a complaint with BBB I do understand I got behind however when I got behind I owed $1786.00 out of $17, 000.00
I guess I am a bum and I had almost $200 in fees plus intrest but I did PAY in FULL so they better lose my number I would think twice before you use this Company. I have also asked how to contact Corprate and asked for a fax or letter with pay off and they refuse

Horrible service
I traded in my car. Wachovia got paid, cashed check yet customer service kept telling me they haven't recieved any payment. You can't get past them and they insist you have to continue making payments though you have all the proof to show they've cashed the check.
Never again will I do business with Wachovia.

Be very careful!
I experienced a terrible and disgusted attitude from an individual by the name Brandy. Back in September 09 I received a call from (Anaheim CA) this person in a very offensive, threatening and disrespectful manner, not giving me the chance to speak but cutting me off in every word that I was trying to explain, I believe that’s very rude.
Just because my account was late it doesn’t mean you have the right to humiliated me in such way. I’m very disappointed with Wachovia Dealer Services and the way they treated me as a customer and the lack of professionalism. Employees with lack of respect and customer service skills shouldn’t be dealing with customer.
I called back that day to file a complaint; I spoke with Brian who helped me.
I request a letter of apology. Mr. Brian told me that he will pass this complaint to Mrs. Natalie Summers but I have not heard from no body from Wachovia Dealer Services seems like no body cares about the customers and their feed back and concerns. I Waited couple of months to see if they care about this complain. I know they are better ways to collect the money not showing the poor customer service by disrespecting the customers. Also by listening the customers and give them a chance to explain.
I work also in a professional environment dealing with customers. I know how tough the situations are for our customers, but it doesn’t give me the right to disrespect, humiliate them and act unprofessional.

Persistent Harassment
I cosigned a car loan for my ex and he was late on a payment but then sent a payment which they lost and collections has been calling me and harassing me night and day to pay them. My ex moved to Fla., I gave them all of his contact information and they continue to harass me to make the payment because they work on commission. He is working with Wachovia to locate the lost money order and he has informed collections that this is the case. They will tell you whatever lies they can think of to get you to make the payment and when they see that doesn't work, they try other ones, they said they were going to sue me, that if the car was repossessed I would have to pay the fees... its all nonsense! Michelle from collections even went so far as to call my job, I have no clue how she got the number because I had not given it to them and fraudently misrepresent herself by acting like she was one of my students to speak with me. They are sad, pathetic, unprofessional and very uncoordinated. Do not give Wachovia any of your business!

Extension Payment
I called to try to get an extension on one payment they were telling me that you have to make 12 payments before they will let you do that, they were very rude. I'm telling you that Wachovia Dealer Services isn't worth anything.

repossed my car
I have to add my story to all this as my car was repossed yesterday morning and the repo company in phoenix requires that I pay a fee to get my personal belongings out of the car. And this is another story . Obviously the people out there with their hands in my pocket and everyone elses. This makes the only sense I can come up with wether you are two weeks or two months behind on you car loan Wachovia is repossing the vechicles. It looks like they are upside down on the loan of these vechicles based on alot of articles blogs ect I have been reading so rather than help you keep your car ...( god know why you need it) a job ..kids ..dr's appt..just basic getting around because phoenix has such a wonderful transit system..NOT! They are repossing at an alarming rate I have a friend who was a repo man and he has contacts he called them and they said yes Wachovia is repo ing every thing no matter how late..and they don't understand. I do! My car loan was 10, 000 on a 2005 vibe...my car value is 4, 888.00 based on the DMV. Now they would rather take my car and sell it for the value of the car then make money...why?? Wells Fargo bought them ..wachovia fell apart and was drowning..wells fargo walks in and has whatever in assests ect. and now wachovia feels or is empowered to take ..they are now under the umbrella of another bank.. Wachovia 's colllectors are the most harassing, rudest, under handed unscroupulos people I have ever spoken with. They refuse to let you make a payment unless you give them permission to take another the next month..and I was hung up on when I said I couldn't not knowing when my child support would come in and the guy said " nastly " good day..and hung up!! I have called many wachovia numbers asking for a supervisor or a manager and I was always ALWAYS directed back to the same nasty collector I had been dealing with..I have read many others who were also told the collector who has your account is the only manager and supervisor available. This honest upstanding collector got into my ACHS acct. which was set up back when I aquired the loan I worked late an this was the easiest way to pay the bill. They refused to take this web page of mine down..and their collector or the one who had my account was taking it upon himself to take the payment from that account without my permission month after month after month. I was getting nowhere with WAchovia about this. I contacted my bank of thirty years Wells Fargo basically told by the branch manager there was nothing they could do and they would be sorry to see my go ...because, my only choice obviously was to close my account and go to another bank. Finally I called the 1-800 number to the bank and the rep stated I could file it as fraud. ALL I WANTED was for Wells fargo to block wachovia from DIPPING in my account thru a back door!!! Wells fargo found the transaction as fraud...I had no confirmation code that I apporved this no check number...they sent a picture of this blank square with check typed in the middle...they reversed that payment after I received the letter and put me two payments behind...so I had the other payment and I was going in that morning to pay and that morning at 3 am a repo truck is taking my car...a neighbor watched the end as he was leaving for work. I called and they refuse to refuse to let me pay the back owing they want the full 10, 000. Sounds like stealing to me...BTW they also use the ACHS system to go in a put pending amount that makes it look like you owe them two months constantly... I want to know why no ONE is doing anything about them...I know California is hurting ..but so is ARIZONA and many many states...why is this being allowed to happen. I had an interview next week...but taking my car has solved my problem of getting a job...I don't have transportation any more...and the states ..wonder why people have stopped looking for work??? COULD it be they don't have a car to get to a job anymore????????????
