Conniving Thieves
Wachovia has made many, many banking "errors" on my checking account over the years. I understand that we're all human, and we all make mistakes from time to time. However, Wachovia employees have perfected deflecting blame for their mistakes back onto their customers.
In August 2009, I deposited $300 cash into my Wachovia checking account at a branch ATM. It was approximately 7 am, and the bank was not open yet. About a week later, I received a letter from Wachovia with a copy of a bounced check posted to my account. The check was for $300 exactly and was deposited the same day as my deposit. However, the check was not written by or to me. Clearly, this check was not mine. A bank representative had confused my deposit with someone else's, had written my account number on the back of the check, and deposited it to my account. When the check bounced, Wachovia debited the $300 from my account and charged me a fee for the bounced check, which caused overdrafts on my account. I called Wachovia the same day, a Friday, and explained what I assumed had happened in error. I was very nice and understanding and did not take it out on the representative. The representative was very nice, but asked me if I had deposited the check into my account for someone else. I asked her, isn’t that illegal? She could not answer me. The representative filed a resolution ticket and told me to call the resolution department the next day before noon. The next day, I called but the resolution department had no record of the ticket; the representative had sent the ticket to the wrong department. Not only did the department who received the ticket not forward it to the correct department, but no one bothered to contact me as a courtesy. Furthermore, the only persons who could take any action with the ticket do not work on weekends. I asked to speak with the supervisor, but he had left for the day and conveniently would be on vacation for the next week. I asked the representative how there could not be any supervisors on duty in the great corporation of Wachovia; the representative couldn’t answer me.
Every other day for the next two weeks, I called to check on the status of the ticket. I lost the direct number to the department, so I had to call customer service first. Half the customer service reps had no idea what the resolution department was and transferred me to the wrong departments. Some even tried to correct me on what the department was called. One girl transferred me to the Wells Fargo investor support line. In addition, all the representatives made me repeat the story to them before they would transfer me even though I told them I already had an open ticket. To their credit, each of them realized the error was Wachovia's fault and not mine. The "investigator" who received the ticket still had not taken any action, and the original overdraft error caused many more overdrafts. So, my account was overdrawn by $800 and I could not use my card for anything. Needless to say, I had lost my patience and understanding. Wachovia protects their "investigators" from actually speaking to any customers, so customers must always speak to a clerical person who has no authority. Furthermore, the clerical persons "review" the complaints for the sole purpose of figuring out how the customer is at fault. I repeatedly requested the "investigator" assigned to my account call me because I was tired of speaking to rude and ignorant customer service reps and clerical persons. The investigator never called and would not provide her direct contact information.
Finally, I called the resolution department again three weeks after my first call. The clerk put me on hold to speak with the "investigator, " and then repeated back to me what the "investigator" said. Not only did the "investigator" outright refuse to correct the error, but she said I would have to go speak with the branch manager at the bank where I deposited the check myself. I asked, through the clerk, wasn't this the investigator's job? Wouldn't it be much easier for one Wachovia employee to communicate with another Wachovia employee since they have access to the same systems and can review identical information together? And furthermore, if it was as simple as a visit to the branch itself, why didn't she just tell me that three weeks ago? The investigator simply repeated her instructions. I wish I remembered her name...
I visited the branch the next day, and the branch manager was appalled at the investigator's response. I gave him my documentation, and he too could see the error was clearly on Wachovia. The branch manager made a few calls and was able to speak with the manager over the resolution department. The next day, the branch manager called me to inform me that the error was corrected. Great! Except, Wachovia did not return any of the fees from the overdrafts. So another call to the resolution department and another clerical person talking to me like I'm stupid and how this is all somehow my fault. Finally, the resolution department refunded the overdraft/insufficient funds charges, but not after a lot of headaches and frustration. And to top it all off, not before preaching to me that I really should open another account with them and link it to my current account to avoid future overdrafts. Ha!

Loan Modification
Wachovia is one of the most fraudalent companies... they first tell you they cant help with a modification since you are current... so they suggest that if I am not current for 3 months they will be able to asssit... It was a matter of time and I became victim and was no longer able to pay the mortgage. I was offered a modification with payments more than i was paying in the beginning... if i cant pay 1500 how am i going to pay 1800?
We went to mediation and now they say I do not qualify due to a high forebearance... I am able to make mortgage payments... BUT I owe nearly 100K more than this home is worth..
Wachovia even went so far as to request BEFORE FILING FORECLOSURE... for me to send my garage door opener and the keys to my home.
I am going to file a counterclaim...
anyone else have the same sort of situation... lets all sue under a CLASS ACTION SUIT!!!

Everyone should be warned, their policy allows the following: They told me that a cash deposit would be available at a certain time and date, but it wasn't, and they are allowed to chose the largest withdrawal out of any that post that day, regardless of order, and return them as insufficient. In my case, this caused an NSF fee, which is allowed to be taken out before they pay the rest of the checks, causing the next check to bounce and another NSF fee, so on down the line, for a total of 7 checks returned NSF and a total of $245 of NSF fees. If they had paid the checks in the order they hit the bank, even without the deposit being posted when promised, there would have been an overdrawn amount of less than $10 and even with an NSF fee, none of the others would have bounced.
At the time this occurred, I had $5000 in another account in the same bank, the same branch, and perfect credit. They refused to refund the NSF fees and correct the situation.
I closed my account. Warn your friends and family of this deceptive practice, it's just a scam for them to get money.

I have had $100 vanish from cash deposited at a drive thru teller from the time I put it in the tube to it getting to the teller (supposedly) two weeks in a row.

Fraud
Had a total balance of $122, $121 of transactions. Had $1 *and some change* left over but they still charged me $140 in overdraft fees. I caught a screen shot of it showing my left over balance BEFORE the overdraft fee was $1.44, after overdraft fees was -$138.56. So it was after the overdraft fees I was in the negative. How is that possible? Calling Wachovia, I talked to the dumbest woman on the face of the planet. They have the worst customer service.

Overdraft Fees
Yesterday I checked my account online and it said I had 60 dollars left in my account and nothing holding. I went out and brought something for 21.18 and then 18.32 which would’ve brought my account to about 20 dollars, since I have direct deposit I didn't worry about it( it was going in last night). Until I checked my online banking today... and noticed I received an overdraft fee of 175 dollars. This was taking against my direct deposit. I immediately called the bank and the first customer service rep informed me that a $50 automated debit from my cell phone company had went through last night and which put me in the negative, so things that were already posted to the account that had lower values were pushed up and the 50 dollar charge was place first for my 4/15/10 purchases (even though it didn't technically post till after midnight) which meant the 5 other charges I had went into negative and 35 dollars NSF for each one. Also my balance was kicked back to my 4/14/10 balance of 120.07 so everything that posted 4/15/10 was deducted from that amount and largest to smallest which also contributed to the overdraft fees. None of this was reflected on my online banking. This is ridiculous and misleading...and I'm thinking illegal now. How can you post purchases to my account, show them as paid and then add another charge and decide to make that purchase negative because the last charge was the higher amount???? Customer service refused to give me any kind of credit, and I was transferred to another department...was on hold for exactly 1hr and 17 mins and 32 secs before someone answered my call and the gentleman whom I spoke with was rude...and basically told me that online banking wasn't a true record but that’s not the banks fault, and I should keep up with my money better. Then when I asked to speak to a manger he refused to transfer me to anyone else and told me that I have exhausted all other means to get the problem fixed and have a nice day. So I have bills to pay and I'm out 175 dollars because of Wachovia.

Double-dipping for overdraft fees
I have been banking with wachovia for 4 years, and in the last six months their customer service has gone to absolute hell. over two days, I bought roughly $41 dollars in products while I had just short of $40 dollars in my account. while I understand being charged with an ODF for the final purchase that pushed me into the red, wachovia applied a hold on the FIRST few items I bought and waited until I was in the red to apply them - even though they had already withdrawn the money from my account! In short, I ended up being charged FIVE overdraft fees of $35 dollars each because wachovia predatorily withheld holds on purchases.
This isn't even the best part, though. If Wachovia had simply withdrawn the money for the first purchases and left it at that, then I would have only been hit with one fee. But, after withholding it, they WAITED UNTIL AFTER THE FIRST ODF WAS APPLIED to ADD THEM BACK IN, then withdrew the money again to hit me with several MORE ODF fines! even better, if Wachovia had simply waited to take the first purchases out until last, I STILL would have only had to pay one fee!
In short, do not use this bank. If you DO use this bank, withdraw all your money and close your account! If you keep using them, they WILL find an excuse to screw you.

overdraft fees
Can you please investigate Wachovia bank/wells Fargo overdraft policy. I know banks charge overdraft fees but some banks go too far. How can a bank charge 3 overdraft fees of 35 each in less than four days, especially for the way they set up there system. Before using my check card I always check my account to make sure I have funds to cover my transaction. Also my bank also informed me several times that once a transaction is placed on hold that they already hold that funds then how can the charge me overdraft fee for those transaction when they post to your account. Also if all transaction have either post or on hold shouldn't be subtracted from your balance and what ever is available is available to you as the reps are always informing when asked. Please verify there policy and investigate because they inform there agents of the correct procedures and we customer should not have to pay for there errors please. Fees
On Friday March 5th I made a deposit for $ 825.00 which posted that same day and on Monday March 8th I made another depoit for $200.00 which did not post till the next day they were both cash deposits and both deposits were made after 4:00 pm ...I have bank records and deposits for proof...Since, my Monday deposit did not go in till the next day I incurred 11 NSF Fees in one day 3 the next and well 1 tomorrow for a total of $ 525.00... The stupid part of this was that the charges that were paid did not even total $100.00...I went into the bank and demanded an explaination the only thing the bank manager told me that funds were available to me but not for debits? Can anyone make sense of this? How can a banking facilty do this and get away with it? This is HIGHWAY robbery...DO NOT USE WACHAVIA!!!
