DO NOT BANK WITH WACHOVIA
Okay i have banked with wachovia for a long time i would get overdraft fees here and there and never questioned them i just figured it took longer for something to come out i am questioning every single one i have ever recieved now... earlier this month i went to cash a check and they said i couldn't b/c my account was 337.00 negative...i was shocked...so i went home and checked my online statement..and compared it to the one they had printed out...it was crazy how totally different it was they were saying i over drafted on 8 things and on my online account it only said 2 things were...so i call customer service everyone i talked to was acting like i was crazy for not seeing i over drafted on all 8 things...on my online statement it showed where the money was taken out for 5 things and my balance was carried every time and i had the money for all items..so i went to the bank i always go to.. the tellers know my name and everything..well i had never met the bank manager vicky and i wish wouldn't of had to..i tried to explain why i didn't think i should have all those fees..like all the people i talked to in customer service she acted rude and snobby and said i clearly over drafted and i have to pay the fees..so i told her i would be back with a printout of my online statement..i came back and showed her..she acknowledged that it was showing a positive balance but it really wasn't positive(okay that makes sense)...she went through a bunch of nonsense about holds and ran around the whole issue that my account statement was just plain deceiving..i had talked to a customer service person that credited 70.00 ..well i asked her now seeing what i have been looking if she could remove more fees since it was so misleading..she said no once there is a refund done she couldn't change it...long story a little shorter i left crying...so for the next 2 weeks i went back and forth with customer service all rude and not listening to anything i was saying...in this time i talked to someone in online technical and he told me people call all the time about there online banking statements being misleading..but he could not help..so then i talked to guy named chris smith he told me he understood and that it is bank error and that he could take off 2 more fees to make my balance 197.00 i was finally relieved somewhat..i felt some sort of justice for what was being done..well i did not have my credit card with me i was going to have to wait til i got home to pay...he told me just call back and ask for him and everything would be taken care of..well it was all a lie..when i got home i called nobody seem to know who he was nothing was noted on my account..and then they went on to say my account was no longer in overdraft resolutions and it was maybe in another branch of the department..they could transfer me to customer service and they could figure it out..well they were wrong..customer service transferred me right back to overdraft resolutions who said i should just talk to my bank about the issue..well i wasn't going to do that since i would just have to talk to that manager who shouldn't even be a manager..i collected myself and said i will just call back tommorow..so i did again i got a very rude and smart mouth person in customer service who said she dosen't know why chris smith in overdraft resolutions would tell me that he could waive more fees when they shouldn't be waived in the first place so i told her i wanted to be transferred to someone else..thats when kim thompson comes in..i explained to her how i have talked to about everyone and some people understand and some don't and finally chris smith had and said he could help me but i can't get transferred back to him...she said well ms.mashburn wouldn't you think if he said that he would waive the fees he would've noted it and waived the fees on the computer? i could not believed that those words came out of her mouth and the rude snobby tone which they train there service people to use so you will just get so frustrated you pay the fees...so i told her i was not lying and that he did say that..she said she never said i was lying..even though she definitely implied it..she looked over my account and said she wasn't going to give me anymore money..i was outraged i did raise my voice saying that this was not fair that one employee could say fees could be waived and now they can't..she said she would discontinue the call if i did not calm down...which was so uncalled for since i just raised my voice out of frustration..i kept saying that i wanted to know why the fees could not be waived she said the conversation was going no anywhere because she is not waiving anymore fees..i started to get upset because i felt totally betrayed by a bank that i once trusted..she said she would try to contact this chris smith and vicky that i talked to at my bank..i was put on hold for a good 5 to 7 mins. she said she could not reach chris and again said that the fees would not be waived...i honestly think she just put me on hold and went to the bathroom...i told her i was not pleased at all with the way i have been treated and lied to..she said i just need to pay...i am now paying the fees i shouldn't pay just to close my account...it is ridiculous and what is even worse is that now i have asked around and told my story and it seems like it has happened to alot of people...everyone should pull their money from wachovia..if they haven't got you yet they will...they are not working with you they are working against you...tell everyone you know.. i have.. and if anyone knows of a lawyer that is interested in taking them on i would love to know..they would have a good case because what the bank is doing is wrong...i hope something is done so people can not be used to make the bank richer
consequences...i have been late in credit card payments since i usually pay online with my debit card...i have been stressed out everyday since this has started i am a hard working single mom and simply can not afford this

Fraudulent company
A payment I mailed in to Wachovia Dealer services in August 2008, clearly stated to be applied to principal. The payment was not applied to principal. Instead, it was split into a monthly payment for October, and the remainder applied to principal. October's billing statement, stated that the next bill was not due until November.
My next payment was made 11/14 and almost all of the payment was applied to interest. Their reasoning was that no payment had been mad in October. Their representatives were very uncooperative in resolving this mis-application and as a result the matter was not cleared up completely, only made worse.
The payment which virtually all went ot interest in November was not refunded or altered. They mad no changes at all until mid-December, at that time my December bill had already been paid but as the situation was'resolved' the payment taken from principal and applied to a monthly, was reapplied to principal leaving a void payment for October.
So they moved all the payments back a month, causing me to have to make an extra payment in December. By this time the payment was so close to the due date, that again, a lot of the payment went to interest instead of principal. This also incurred un-expected financial injury on myself as the extra payment was required in December. This also reflected in my payment being made later than usual in January. This also caused more of the payment to go to interest instead of principal. All in all, besides their outrageous interest rates. They have scammed me out of almost $1000!!!
I tried to refinance recently and get away from them, and mysteriously, my credit score has dropped in the last year after making all my payments on time on all my debts with no negative reports. In actuality it should have gone up. I think they have some thing to do with dropping my credit score so that I can not re-finance!
How many people don't pay attention to their balance throughout the year? How many people have they been doing this to, are doing this to, and will do. They need shut down!

Will not answer the status of my loan app
I applied for an FHA loan about 4 months ago. Had an appraisal completed and the paperwork was submitted about 2 to 2 1/2 months ago. I've sent many e-mails asking what the status is, good, bad, ugly..told them I didn't even care if they told me they lost it...just tell me something...and they simply don't...not sure how to complain about this...certainly I should have the right to at least know the status of my loan.

Mortgage Refinance
We just refinanced with Wachovia. Deal was for 20 yr fixed rate at 4.875%, with Wachovia giving $2094.00 at closing. Dealing with person NC, told she'd call me with HUD info. Never did. Went to closing and Wachovia reduced their credit to $1256.00. I called the Wachovia rep I was dealing with (right there at the table at closing!) and she said she didn't know why the credit was lowered and said she'd call back. After 5 minutes, she calls and says "Oh, your appraisal was lower than your estimate." Three weeks before she told me that was not a problem because our equity in the house was more than enough to avoid PMI. Not once mentioning, nor did I sign anything that this amount could be lowered at any time. Anyway, beware of Wachovia mortgages! Unfortunately, I have been a customer with Wachovia (started with Central Fidelity) for over 25 years, and now I will close all of my accounts at that bank. Is it a wonder that they were going under until Wells Fargo bailed them out?
Ok, Wachovia, I I'm taking my 80 grand in various accts out of Wachovia, and pray to god you sell my loan.

Secret life insurance policies on employees

HOUSTON, Jan 13, 2009 (BUSINESS WIRE)-- Attorneys from Houston's The Clearman Law Firm ( www.clearmanlaw.com ) are announcing a nationwide investigation of banks that have purchased secret life insurance policies in order to collect benefits when current and former employees die.
Many of the world's largest banks have purchased "bank-owned life insurance" or "BOLI" for years, including Bank of America, JP Morgan Chase, Bear Stearns, Citigroup, Wachovia, Washington Mutual, Wells Fargo and many others.
"We are investigating banks that insure the lives of employees without their knowledge or consent, " says class-action attorney Scott Clearman of The Clearman Law Firm. "These types of policies benefit only the banks, not their employees."
In a BOLI program, a bank designates itself as the beneficiary of life insurance policies covering its employees. Nearly half of all U.S. banks have reported owning BOLI policies at an estimated value of $120 billion.
A bank purchasing a BOLI policy must provide the insurer with personal information belonging to each covered employee, including his or her name, sex, age and Social Security number. Employees' Social Security numbers are then used to conduct "death sweeps" where banks typically hire outside brokers to sweep public records in order to learn if an employee or former employee has died.
A person whose life a bank insured without consent may have a right to sue for the bank's misappropriation of their identity (name, sex, age and Social Security number). Employees may be able to recover profits made by the bank, broker and insurer.
"It is ironic that thousands of bank employees have been laid off, and yet the banks still stand to benefit financially when those employees die, " says Mr. Clearman.
Since the early 1990s, Mr. Clearman has been a pioneer in class-action lawsuits against employers for wrongfully insuring employees' lives for the employers' benefit. Following several individual lawsuits for the families of deceased employees, Mr. Clearman pursued landmark class-action claims against Wal-Mart and Fina that resulted in major settlements for his clients.

Overcharged
I live in Yonkers, NY. I am on maternity leave. I receive disability checks from GE financial.Because it is hard for me to go to manhattan where my bank ( United nations Federal Credit Union) is located, I usually mail my checks after I sign the back, write my account number and mention ' deposit only'.I also always send my checks via certified mail. Have been doing this for years never had any problems. My checks where always deposited into my account.
On March 22 I mailed certified, a check for $313.99 To UNFCU. one week letter I still had not received the return portion of the receipt and nothing was deposited into my account.I Called the post office after 10 days they stated the mail was considered lost. When I called GE financial for them to reissue me a new check and cancel the old one, GE stated that my check had been cashed already. I was in shock. they sent me a copy of the cashed check. Turns out my check was cashed at a Wachovia Bank in Orlando Florida. I do not have an account with Wachovia.
Because the check never got to my bank, UNFCU, they don't want to deal with this. I called Wachovia Bank in Florida, they state my bank has to contact them. They say they cannot deal with me because I do not have an account with them.
How can a check on my name( an my name is not common) that was already signed in the back with my UNFCU account number written and mention ' deposit only' be cashed by a different person in an different bank? this is flat out fraud. Also how did my check end up in orlando Florida? someone at the post office is stealing the mail. I am so upset. I need my check because I am not working right now, I don't know what to do or where to file what.

Overcharged
In October of 2008 my car was broken into at a park and my pocketbook was stolen. I called Wachovia and canceled all of my credit cards with them and closed my checking and savings accounts as well. On Monday I went in to my local branch and filled out numerous pieces of paper work. I then made it very clear that all of my identification was stolen, so I will need a fraud alert on my new account just in case they try to write bad checks. I was assured this would be done by the Branch Manager in Lawrenceville, GA.
1 month and a few days later I check my new checking account and there were 3 checks deposited into my account which were then returned because there was not enough money in my account . So now I have an Overdraft of $2, 493.15. (fees added, of course).
I called Loss Management and complained about the lack of security for Wachovia customers. I filed a report with Gwinnett County Police and I am in the process of getting the video surveillance from all 3 Wachovia branches where they used my name and SSN. And get this one guys... the Wachovia tellers at all 3 branches gave my new account number to the thieves. So they had my account number and my identity. Well I decided that I had enough of Wachovia and their lack of security for hard working customers. I went into my local branch today and closed all of my accounts. I told the Branch Manager ' Your bank can not protect my personal information as you promised and I refuse to keep my hard earned money in a place that does not care about me'. I am now looking into Credit unions. I'm done with Banks...

Awful bank
First of all I believe that this company should be shut down! I think that they should all have to lose their homes so that they could know what kind of devastation they have caused others! My mother had her home for 20 years and that is the home that I grew up in and brought my children home to. That was the home that my mother and my sister and I knew as HOME!
My mother and step mother decided to refinance with home eq, BIG MISTAKE! My step father was injured at work and that is were it all began. Home eq started raising their payments, not compromising and just plain out making things extremely difficult on an already struggling family. after my stepfather passed away they made things even more difficult on my mother she was still making payments but they wouldn't accept partial payments or try to work with her at all.
In the end she just gave up. It is unethical the way that they are allowed to treat people. The many phone calls and hard work was for nothing. My mother had to be hospitalized during the foreclosure process she literally had a nervous breakdown and I hold Home Eq completely responsible! Please never ever use this company. They will cause you nothing but stress aggravation and pain!!

Overdraft rip-off
Early this week (the 16th) I had a doctors appointment, which costed me $30. I didn't have any cash, so I used my debit card. I knew I had about $38 in my account (yeah, I'm poor)to cover it. That day my car insurance also came out. . .something that I had completely forgotten about. It was $28. So, I ended up being $20 overdrawn. I accepted the first overdraft charge of $66 (!!) It had been an oversight on my part, so I was fine with paying it. That was last night. This morning I woke up to find an extra $70 overdraft fee added to my account. ..so I'm now $156 in the negative with $136 of it being in overdraft fees.
I was extremely confused as to why this second fee had appeared. I had overdrawn my account one time before a few years ago by about $40, and there was one flat fee of $60. So, I called customer service, extremely upset. The woman I talked to either didn't know what she was talking about, or Wachovia is about the biggest rip off-er in America.
First, she told me, at the end of the day, the withdrawals are totalled into one number. It didn't matter that I had the money to cover one of the charges, because when they were added up they equalled $58 and I only had $38 in my account. The part that got me was that she couldn't adequately explain the second overdraft fee. I was being charged for two overdrafts because there were two different charges that led to the overdraft; however, there was enough money in the bank to cover one, but since wachovia apparently uses the total instead of individual charges, it didn't matter.
So, they'll make it so you have more overdrafts by using total amounts, but they'll still charge you for each individual amount. (???)
This didn't make sense, so I got rather irate with the woman. Then her explanation seemed to imply that I was being charged another overdraft fee because the first fee had sent it further into overdraft. What???
I never got a suitable explanation for the second overdraft fee, to put it simply. In the end, I get $140 worth of fees for a $20 overdraft. I've never had this kind of trouble from a bank before I switched to wachovia. Needless to say, unless this is fixed (And maybe even if it is) I will NO LONGER be banking with Wachovia, and I'll be sure to warn all my friends about them.

Mortgage fraud
I have one of the World/Wachovia mortgage loans that falls under the subprime/preditory lending act My credit is in the toilet because I have been trying to keep up with the loan payments, was told that my loan was convertable to fix rate without any paperwork needing to be filed and no cost to me, then when I go to excercise the option i am told by my broker (At Wachovia, the one one did the loan) that the option is not available to me. so I try to refinance my loan to a fixed 30 year and am denied because my debt to income ratio is to high (not to mention my house is now $200k upside down) so I asked for an extension to pay off what little debt I owed so I could bring down the number and oddly enough I am denied again...with the same explanation "Debt to income to high" WTF is goin on here? please feel to email me with how and what I can do to fix this problem.
