i had a home in san diego ca.i wanted to buy another in ramona ca.at that time the bank was world savings.it then changed to wachovia.it is now wells fargo.the loan officer told us we needed to take out two different loans.one to take money out for a remodel of the original home.at that time it was worth about $950k.there was a loan of about $440k.then we were told we need another loan for the new home, also $440k.we also had to put down $121k.at the time, the new home was bank owned.we made a lower offer.we wwere told we had to pay the full asking price of $570k.the home was suppose to be worth $652k.we were told at that time because we were going to sell the original home, we should just get 15 year adjustable loans on both.we had planned to sell the original home and pay off both homes.at that time the housing market changed.we could not sell it for that price.so we rented it out.we were making some payment on it, not full ones.but the bank was accepting them.then we had to evict the tenant this year for non-payment of rent.of course wachovia swooped in and filed for a foreclosure process.the home at time was now worth a lot less.we ended up after waitng for them to modify the loan for close to two years, selling the house on short sale last month for $350k.now while trying to keep paying on the other home, we got behind on the new home.but we were only owing about $7k.next thing we know it was jacked up to close to $23k.we had asked for a re-payment plan back when it was about $7k.we were told to fax in lots of documents.we faxed them.now they are telling me today that they did not receive them, we did not call back for phone interview.i called back another person, they say they received the papers but now it's too late so they want to foreclose on the 24th.they told my real estate agent another story earlier today.so now i have to go pay for an atorney and pobably file papers with our DA here in San Diego.plus file a case of elder abuse against Wachovia/WellsFargo.i am sure there was some illegal dealings with the loans.we gave up our other home to save this one.so we will fight to the finish.all we want is to start making our payments again like we were told we could.we offered to send in a large sum, we were told to hold onto it and not send it at that time. this house is now worth $350k, half of what it was suppose to be.so Wachovia/Wells Fargo needs to step up and do the right thing as they promised.we will be filing the papers with the DA on monday and the papers for Elder abuse.i was 69 when the loans were taken out.they for sure took advantage of me.i will see attorney on monday.wish me luck.
