loan modification
I have tried twice for a loan modification. The first time was told I didn't make enough money, so got another PT job and applied again. I was told I made enough money but was not in any imminent danger of foreclosure so was denied again. Basically I was told I needed to miss some payments in order to even be considered for a modification. I wrote letters and called to the presidents and received a letter stating that I can not get a loan modification at this time. I have never missed a payment since 1997 when I bought my house. They seem to change rules daily. They have now automatically added my property taxes to my monthly payment when I have been making my prop. tax payments separately. They also cut off my line of credit even though I have not used this account in months. It seems their way of doing business is a complete joke.

Unfair lending practices
My daughter sold her house in Fort Myers to a couple who in turn sold their house on Fort Myers beach for $315, 000. The closing date was set, and the loans were pre-approved with appraisals.
Everyone took their houses off the market pending the sale and closing. The week before the closing date, Wachovia/Wells Fargo arbitrarily decided to lower the appraisal of the house on the beach to $260, 000 therefore killing the deal at the last minute and then they did not have to loan the money, and everyone's plans and lives were thrown a giant financial burden.
Now the houses were off the market for months, losing valuable selling time and my daughter was unable to move and get a job. This complete arrogance on the part of Wachovia/Wells, and their determination not to lend any money anyway they can get out of it, is what is contributing to the crumbling housing market in Florida and making people miserable. Wachovia/Well's rediculous "we are with you" ads are an insult to our intelligence and we are on a giant crusade to help people realize that their money would be welcome somewhere else, where the company truly cares about it's customers rather than spouting that phony freinds routine.

Missing Money
I have never been so mad at a bank as I am right now. I made a deposit at a Wells Fargo Branch in CA yesterday and the money is not in my account. I actually had a supervisor tell me he has no idea where my money is. I have a receipt of the deposit. I cannot believe the dis-respectfulness of customer service at this bank, both at the Wells Fargo branch at the Wachovia customer service line. I would like to know where my money is and why after 24 hours it still has not posted to my account. This was mostly a cash deposit (90% cash and 10% in checks)

I would like some answers immediately and don't try to tell me that it takes a few days to post, that is ridiculous, withdrawals at the same branch posted immediately

Illegally Forced Insurance/Harassment
Wachovia FORCED insurance on me illegally.
I have documentation from Allstate proving that my coverage homeowner's insurance never lapsed.
I also have a letter from my lawyer dated last year requesting that the Line of Credit and account be cancelled.
They failed to cancel my account and then added the insurance charge this year.
They also placed the line of credit on the wrong property.
I am receiving harassing phone calls from them (for THEIR ERRORS) and the stress of dealing with this is affecting my health issues

Bank Errors / harassment
I took out a Prime Equity Line of Credit with Wachovia in 2004.
I HAVE NEVER USED IT AND MY BALANCE HAS ALWAYS BEEN ZERO.
Well, first off they put it on the WRONG PROPERTY
(I gave them the PIN number, lot number and address three times and they wrote it down.
FIVE YEARS LATER, when it came time for me to sell the rental lot, I had to race with a letter from my lawyer to Wachovia to get them to CANCEL the line of credit placed on the wrong property.
They faxed the proper forms to my lawyer, but FAILED TO CANCEL THE ACCOUNT.
(The gentleman at my local Wachovia demanded a $100.00 charge to put the line of credit on the CORRECT account, which I refused.) Their mistake, not mine.
I found that my account had NOT been properly cancelled SIX MONTHS LATER when I received a bill for $1, 118.00 for an insurance policy that they FORCED because my homeowner's insurance supposedly had lapsed.
(My homeowner's insurance has NEVER lapsed.)
I have faxed letters from my lawyer (from my local Wachovia's fax machine) to other divisions of Wachovia/Wells Fargo in addition to letters and documents from my insurance agent.

These letters and documents prove that Wachovia/Wells Fargo FAILED TO CANCEL MY ACCOUNT AND THAT CHARGES WERE FORCED ON ME ILLEGALLY.

They will never admit that they have made a mistake and will swear you have not provided proper documentation unless you actually go to your local bank and fax the papers from there.
THEN you need to call the branch and CONFIRM that they actually received the faxes
and follow up because they will
drag their feet,
lose your forms,
claim you left out a form,
(all so they can charge more interest)
and then you will receive harassing calls from a different division demanding payment which you may or may not owe. (Ask me how I know this.) Still fighting this out with them.
Damage Resulting = Emotional stress, Fibromyalgia pain and Chronic Fatigue and general health made worse.
THREAT OF DAMAGE TO CREDIT RATING.

Wachovia Loan Modification
I began our loan modification process with Wachovia back in Oct. 2009 and to date we still haven't been able to finalize it. I find it absolutely stomach churning that every single god given financial documentation was provided to them (within 24 to 48 hours after Wachovia's request), and they still managed to delay the review process by claiming that the fax was never rec'd, the date was missing, the name was misspelt, Snoopy ate the mailbox, and Garfield, the cat, jumped on the stack of papers and his lice/fleas ate the documents!...seriously, my 5 year old son has better (and thankfully less) excuses then the Reps at Wachovia.

Well, I don't know about you guys, but quite frankly, I've had enough. Wachovia shouldn't have accepted the bailout money from the gov't (which is really our hard earned tax dollars) if they had no intentions on bailing out anyone other than themselves! I've sued Wachovia in the past (before they acquired World Savings Bank) for extending a prepayment penalty fee and I had the entire matter resolved within 1 week...and mind you, I am not an attorney, never went to law school, and I sued completely on my own. Now, that being said, I took some of my own steps yet again for the 2nd time in hopes of getting what I was promised when we initially went through the phone interview: (1) 2% fixed interest rate; (2) lower monthly payment that included my escrows; (3) keeping my home (especially since we put 20% down payment on the purchase price back in 2005). I am keeping my fingers crossed that I will succeed for the 2nd time but it's never a guarantee!

I think that if we all ban together (picture the Boston Tea Party) and everyone writes or files a complaint to the addresses listed below, then they will have no other choice but to listen and comply. My filed complaint alone is completely useless unless it's backed up by everyone else who is experiencing the same difficulties. Below you will find the steps in filing a lawsuit and complaint in your own County, but please keep in mind that all we can do is try our best and hope it'll work:

1. gather all docs and any fax/mail/email/fed ex confirmations sent to Wachovia;
2. organize in accordance to date, all phone calls made to Wachovia, whom you spoke with, and the topic covered during that conversation;
3. go to your County's website or google "how to file a complaint in _____ County". Once at the website, you can download the forms you need to complete in order to file a lawsuit. Be watchful of the Complaint you submit to Court, because there may be 2 different lawsuit forms: (1) small claims (typically used if you are suing for less than $6, 000); and (2) civil complaint.
4. If you do not have access to the web or your county does not provide this online, you can visit your county clerk and ask for the forms directly.
5. in addition to filing your own lawsuit, file a complaint online with the Department of Banking and Insurance and also with Thrift Supervisory.
6. Lastly, once you have a copy of your filed lawsuit at hand, along with all the other online complaints you filed, feel free to drop a few lines to the following people at Wachovia:
