Fraudulent loan modification practices

Are you in the process of a loan modification with Wells Fargo? I'd like to share my story and I'll bet many are being treated the same by Wells Fargo(WF).
My partner and I are disabled and living on a fixed income. We had a large investment account that was managed(mismanaged) by WF. We paid our mortgage on time for many years but due to the economic downturn, our stocks dwindled. Realizing this we turned to Wells Fargo to begin the modification process. We submitted all papaerwork asked of us in a timely manner but whenever we asked the status of our modification we were told that paperwork was not complete, they had not received the requested paperwork or that we would have to wait 90 days to receive a response. The outcome was always that our case was rejected After eighteen months of this we hired and attorney. Within two weeks of that we received a loan modification amout to pay. We were to pass a three month trial period in which our payments must be received by WF before the first of the month. We were told that after the second month, we would receive papers finalizing our modification. Three months passed and we were told to keep making payments until told otherwise. Two more months passed, WF requiring updated expense reports, bank statements and an updated hardship letter. We complied with all requests in a timely manner(all communication between us and WF went through our attorney) but were rejected because we didn't file the documennts requested in a timely manner and had too much unsecured debt. Our lawyer kept accurate details of contact with WF so the first reasom to reject us was not valid. The second was also not valid since at WF "suggestion" we declared bankruptcy. We had been told that in order to qualify for a HAMP program, we needed to get rid of our unsecured debt somehow. That seemed like bakruptcy was our only option. When we approach our attorney, we had completed the bankruptcy and all debts were discharged.
We were told by WF that the reduced modification amount we had during our trial period was no longer valid but they had their own modification program. Basically a bait and swich in that our monthly payment was only $150 lower than the original payment and did not include escrow where the original modification did and was much lower. Also they were so kind to tack on all kinds of late fees and fines to the original loan amount. Of course, any payments that we had made during the trial period were not deducted from those amounts. Our attorney suggested that we stop making payments to WF and force mediation. Our mediation date is scheduled for June 24, 2011. I don't have any great expectations given WF history of deceipt. I believe that we will ultimately have to take WF to court to get this resolved.
I would like to urge all others not to just leave your home. Get an attorney and fight. If enough of us little guys fight back we will win. We must win. Remember David and Goliath? Ask your mortgage company to produce the note saying that they own the mortgage. I'll bet they can't since most mortgages are sold and resold.
I also urge that if you're having a difficult time paying your mortgage, under water with your mortgage, stop paying. Send these leaches of society, the banks, a message.
Lastly, I urge anyone that is disabled for any reason and is in the modification process to consider that WF is discriminating agianst them by delaying things in order to wear them down and thus have to do nothing. WF has a long record of discrimination on the books. I believe that WF is certainly capable of discriminating in this case. If you believe as I do, please contact me at [email protected]

Unauthorized Payment
Yesterday I received in the mail an overdraft notification from my bank. WELLS FARGO processed a payment on the account that was paid in FULL. I was charged an overdraft in the amount of $33 and after contacting my bank I am informed I will be charged an additional $5 per day in overdraft fees for each day my account is left in a negative balance. I had called WELLS FARGO ahead of time to verify NO PAYMENT would be withdrawn from my checking account and I was assured they had received my pay-0ff and NO MONIES WOULD be taken. Also, WELLS FARGO is holding my lein an excessive long time (they wait 15 business days on a USAA Federal Bank electronic check). I would like my money restored electronically to my bank (no slow turtle mail) and would like the lien released sent overnight to me. Is it not illegal to take money without authorization. And, I faxed all the paperwork that WELLS FARGO requested and have not had an email nor phone call from them yet. Yeah, for no customer service.

Incompetence
Working with client of Wells Fargo investment firm. Needed a simple form from them to help their client close their mortgage refinance. Instead of helping their client, they stonewalled causing the client to lose their loan. Beware of Sunny Landry in Las Vegas. The entire office is incompetant. Her assistant Jackie is a raging -----!!!
Stay away from these guys..there are too many hard working service oriented companies that want your business!

HAMP
Wells Fargo is busy losing my faxes as of 6/14/2011. The lost paper work and request for documents not asked for at the beginning is JUST like so many compliants about wells fargo lying from so many hurting Americans. What can we do to stop this and just get the truth. My quess is you can't bank moral responsibility. A person of mexican descent is handling my HAMP application. Is it possible there is some raceism going on here? I just know i keep getting the run around and and new request for documents that weren't originally asked for. Also, and this is no accident, the person handling my HAMP application works only 4 days a week 2nd shift. That means that, going by my time, all the companies in my area are closing the same time she starts work in California. The result of this is, any document I have to send them is delayed by one more day. They are taking blatent advantage of us. Do something. Time for David to bring down Golioth. I believe the idiots at wells fargo don't think this can happen. Look to the bulshivics and sailors of the Soviet Union before CCCP. It can happen.

They ask me bad questions all year
Their Management team which is their Store Manager Nickie Collier and Manager Yolanda their Teller and Witness reported hateful things about me as a customer to their Corporate Division while having issues and discussions about my behavior with a loud mouth rude Black Older Male customer telling me they allowed to ask me specific things to deposit a check. I cursed the black man out because he specifically kept monitoring what they listening to me bring up to resolve my issues with their normal shady comments they bring up like a person asking where you going every 5 minutes and don't know you from square one. Their employment agency workers act like they were so concern but they discriminated me by allowing the Store Manager to continue to monitor my issues and complaints with the comments they have made and customers joining in to say how they feel with the services being provided themselves. They better get it together because their customer service Bankers and Supervisors and Local Agencies love bringing up my Free Business Account showing in their system as a bad account with bad transaction history when the Bank was Wachovia and I was keeping a active account.

Illegal Disbursal of Checking Account Funds & Fee Charges that Ensued
I am a student and am behind on my child support because of the loss of my job. Children services has placed a lien on my checking account instructing Wells Fargo to send any "Income" to them that got deposited into my checking account. After paying my tuition and board of 1 month, my financial aid office gave me a check for the net proceeds of my financial aid from the federal government. As a requirement of the agreement for this loan from the government, I am NOT permitted to use the funds for anything other than advancing my education, or it is considered a felony. When I deposited this money with Wells Fargo, I made this perfectly clear to the teller, who did nothing to earmark these funds as such. The fact is that Wells Fargo's system is not set up to prevent this chain of events from occurring. I was forced to undergo great stress in straightening out this neglect by Wells. First, my rent check bounced and I was threatened with eviction before I even took my first class. Talk about a rocky start! $35 bounced check charge from Wells as well as from my landlord. $70 total! In addition, a $5 processing charge from Wells for their trouble of sending the funds to Child Support. Now I'm at $75 loss! Next, I had to ask my brother to send a check to my landlord via overnight delivery service (another $20). All told, $95 of costs were incurred. This did not include my pain and suffering which included 1)major stress and fear of being kicked to the street before my first class even began 2) at least an hour of phone time talking with children services before they agreed to return my money (which by the way was the first time in history that they have done so...I feel blessed in that regard). 3) At least an hour waiting on hold and explaining the circumstances to Wells' legal department. After waiting a week for their response and getting none, I was forced to call again and escalate my anxiety to "supervisor" level. 4) Three failed attempts to reach the Branch Manager Julian Serna. I left two messages for him to call me in regards to these fees and he claims that he never received either of my messages. On my third attempt, I was placed on hold for 40 minutes before I gave up and proceeded to walk 1.5 miles to see him face to face (the legal department told me that I had to resolve my issue at the branch were the transaction took place...talk about passing the buck!). 5) After waiting for an hour and a half to see the branch manager (his appointment with the prior customer took an hour and a half!) and being the final customer of the day (the bank was closed by this point) he proceeded to invest about 90 seconds reviewing my case on his computer screen and stated that he didn't think Wells did a thing wrong and said "no credit of fees". That's all I got from him AFTER I explained all the hassle he had caused me, the lack of returned phone calls, etc. Do you think I felt like an important Wells Fargo customer at that point? I have never been more humiliated in my entire life! Having had some quality managerial/customer service training in my employment background, I proceeded to explain to Julian how a professional Branch Manager should have handled the situation. That lesson alone was worth $75 to him so now I was even a deeper state of loss to Wells, cause now I was training their employees for free! (sarcasm emphasized!)
Our corporate culture in America has decayed to such a pitiful level. I did not give up in my pursuit of recovering these fees, and ultimately recovered $35 so far. But why did it have to get to this level of bitterness? Wells is now $35 poorer and they STILL have someone that is bitter towards them and willing to pass negative judgement at every opportunity! When instead, if they had nipped it in the bud at the onset, they would have a happy customer. It seems that most large companies nowadays make it their policy to deny ALL claims initially so that a certain percentage of the complainers give up. They they make it extremely difficult for those that persist and another batch of victims give up. Finally for those dumb enough to never say never, they finally give in and provide a refund. (I had a very similar experience with UPS which damaged some merchandise and tried to say that the manufacturers original packaging wasn't sufficient enough to protect the goods) This protocol of claims denial is ludicrous. Corporate America had better wake up and begin paying attention to their customers and treating them with more respect or they will continue to waste advertising dollars trying to recruit new suckers instead of taking care of the customers they already have.

Teller requesting customers to give their account numbers to non Wells Fargo Personnel
A friend that owed me money went to Wells Fargo to deposit what they owed into my account, using my name and address. The teller would not allow them to deposit the money in the account unless this individual could provide them with my account number. I contacted a branch in Yuma and spoke with the manager, she reinforced this policy. I let her know in no uncertain terms, that I had better not, ever again, get a call from someone telling me that Wells Fargo wants me to provide my account number to a non WF employee. I am very upset with this practice. It should not be a banking policy to have individuals provide their account numbers to those not on the account...

Scam
My wife and I decided to change our checking account away from Wells Fargo. When the automatic deposit stopped from company it didn't stop Wells Fargo (after getting a ton of Fed (aka our) money) from continuing to charge our account NSF fees and pay accounts like LA Fitness. After $300 in their fees and $200 in payments to accoun ts we were now paying from our checking acct at a new bank. They took their oney from our son. A 27 year old, living on his own with a job and his own bills . Wells Fargo claims that they are within their rights - wrong. They are crooks, corrupt and immoral. be careful/ if they are acting within the law; then we now know that Obama or not the lawmakers are in the pockets of Wells Fargo and all of their kind.

deposit wrong
I went in yesterday afternoon to deposit money into my account. I am a student at UAB so every dollar counts. I went in with cash, coins, and a check. Granted, I should have checked the slip before I left the store, but I didn't think the "qualified" person counting my money would forget to see that there are tens, fives, and one dollar bills in the stack. The amount deposited into my bank account equaled only the 20's, coins, and check. I am highly disappointed that this has happened. I am supposed to trust that I am putting my money in safe hands. Instead I am being gipped which seems unfair, because I know that there is nothing I can really do about it besides be that one customer that complains.

Illegal tactics
WAAAY back in 2001, now it it 2011, I had a credit card through Wells Fargo, I then lost my job (this is what happens when other people are in control of your career.) I couldn't pay the credit card, I have my priorities and the credit card was not one of them, as the welfare people said. Anyway the debt was turned over to a collection agency, unfortunately I had to report them to the Attorney General for not "playing nice" with me. They decided to cooperate with me and I paid the credit card off through them. Unbeknownst to me, the collection agency sent it back to Wells Fargo as unpaid and they, Wells Fargo never removed this pay off in my profile within their bank. I only found this out when I made a mortagage payment, they tried to put my mortgage payment in the paid off credit card account...which they still had as unpaid from 2001. The statute of limitations has run out and they are still underhandedly trying to collect AGAIN (twice) for this debt that was paid off. When I went to get my federal clearance, I had to prove I paid it, appearantly I did pay it because I got my clearance. Shame on Wells Fargo for deceptive tactics to get money that was already paid. Maybe the collection agency they hired never gave them the money.
