Reporting re-aged debt to credit agencies
I applied to a college in CT, registered for classes. I decided to drop them before classes start to go to another college instead. So I sent the college a letter to drop my classes through certified mail. Well the college "lost" the letter and said I never sent them one. So I showed them proof I mailed it certified, they said it doesn't matter and now I owe a whole semester worth of fee's for the classes I never attended. 15 years later and several collection agencies, Windham Professionals now has the account. They illegally reported the debt as a new debt as of 2011 when it was from 1996. They are bottom feeders and report inaccurate information. I have sent them a cease and desist and sent proof of the old debt to the three credit agencies. I originally disputed them online, but the agencies said they verified them as current debts. So i hope the proof to show the origination of the debt will get rid of it from my credit report...again...

Rude Liars
I admit I let my loan go in default, a very idiotic thing for someone who worked in financial aid for 3 years, but I was trying to make it right. I called Adrianne back to set up a payment plan. I was elidgible for a recovery plan that will essentially wipe the default off of my credit within 9 months. At the time I thought the plan was great and asked Adrianne if she had any other advice. She said that she was not supposed to tell me this but by working two jobs I was making my payment that is set by the loan company higher. " Oh really" I said "so when I finish my second job I should limit myself to one job?" "Absolutely" she tells me. I called today to let them know that I will be finished with my second job on Monday and the company informs me that the amount I pay NEVER changes. I point out that this puts me $-200 in the hole (wouldn't be there if I still had my second job) and the SUPERVISOR says to me "you still make more money then me every month." I called her back later because I realize she's done some calculations wrong and she says "I've already been on the phone with you 3 times." Of course I had to point out that I had only spoken with her twice and that I was just calling to correct an error in the calculations she did. After rudely accusing me of interrupting her several times I finely get her to go over the calculations which were wrong on her part! After I asked for her name and if she had an employee number and told her I would be speaking with her supervisor she became a little sweeter but this was brought on by me stating "You really need to work on your customer service." Her reply "You are not a customer you are a barrower." OUCH!
Anyway long story short (LOL) I could've made $2500 in a month this summer and didn't cause I thought my loan would be cheaper. Now the opportunity has passed me by and I am PISSED!

Took my money and ran
If this company ever calls you to pay off a debt...don't give them any information! I had a defaulted student loan, through my own fault but was trying to make arrangements through sallie mae to get it paid off. As I got older I was finally starting to try to fix up my credit. My first priority was to get my student loans paid off. Windham Professionals contacted me repeatedly with settlement offers. Finally when I got my tax money I paid them almost $2, 000 to settle my account for good. Three months later, no payment or settlement had been paid. They had no problem taking it out of my account but where it went from there, nobody knows! I have repeatedly called SallieMae as well as Windham Professionals (24 calls to date) to get this issue resolved but am getting nowhere. I reported them to the BBB and they lied about all the information I provided, claiming that my account has been settled. Which is funny because usually when I call they can't even find my account! It has now been 8 months since I made the payment to them and I am still getting nowhere. My next step is to contact a lawyer. So, If these "professionals" contact you...give them nothing!!!

Threatening
Was contacted today for the second time in 3 weeks and was told I was put down as a refusal of payment. Spoke to a John Riley, who threatened to bring me to court and threatened to have me kicked out of college for nonpayment of my loans.

Attached Wages
I admit that I owe and am in default of my student loads because I didn't agree with the amount that was owed and once the amount was corrected they were supposed to be consolidated and apply a forbearance because I wasn't employed but somehow these "UNPROFESSIONAL" people ended up trying to collect on my loans. I received a letter back in March that they were going to take my Federal & State income taxes if I didn't reply. I have tried UNSUCCESSFULLY several DOZEN times to contact Danielle @ X2606.
They sent me a request for a hearing back on March 8, 2010, I had to send them last years tax return, my unemployment records, my current wages, I'd only been working 3 months, and all other copies of bills showing debt to income. I sent it return receipt so I know they received it, yet obviously it was ignored. I had been unemployed for more than a year & took a job for $9.50/hr. I'm BARELY paying my rent and bills and just found out I'm pregnant. I NEVER heard from anyone and have tried calling Danielle and ANYONE at Winham all I get is voice mail. Now here it is August, I never got a hearing I request, they took ALL my income taxes close to $5, 000 AND they attached my wages, STILL cant get anyone on the phone so now I have to move before I'm homeless because I cannot afford even my rent on what I make.
My next complain is to the BBB, then my local News Channel who I'm hoping will investigate these people and maybe even a lawyer, I hope everyone does they same!!!

PHONE CALLS
This company has gone way too far and have now been calling my grandma in denver. I think that this is very unprofessional and I really don't appreciate the fact that they have not sent me anything regarding this or even called me or left any messages. Do they not understand that people are broke and have to live pay check to pay check. the believe that the government should really take action and tell these people to lay off due to the fact that our government did get us in this situation and if they don't want to take responsibilities then I don't think that I should. Thank you for your time.

Rude Employee's
Just like many of the people who have voiced their complaints about this company, I too have been receiving harassing phone calls from this very company. I am dealing with a Steven Kirby. He is flat out rude and makes up stories saying I said this or that when I never said any of the things he said I did. He called my mother saying I told her that my parents pay every one of my bills. That is a bold faced lie. I pay my bills with nobody's help. Yes, I have got behind in my student loan payments, but I have made arrangements with the company or companies they were with since they change hands everytime one of these banks buys out another. It's one big hassle. I know I have the debt to pay off and I am not trying to avoid it. I don't appreciate this Windham Profeesionals approach one bit. They are far from "Professional"! Mr. Kirby when I have spoken to him changes his story left and right and then wants me to give him my banking info over the phone, sorry I am not that stupid. I know what you people do you take it and then charge for what you can not thinking to how you are screwing up that persons financial status. Yes they do seem very shady, but what can you do? Just give them the same attitude back. Put them in the same place they put you. Why be civil to an asshole?

i think all of you LOSERS, should quit whining. you've had plenty of time i'm sure to pay your student loans they give you plenty of time before a loan goes to a collection agency to start making payments. maybe, if you had paid your bills on time like you were supposed to, then they wouldn't be calling you in the first place. get jobs losers and pay your bills, quit whining and looking for sympathy be adults work for your money and pay the government back ! it' s losers like you stealing all the governments money for personal benefits and not paying it back! all this time you spend on the computer whining about a collection agency you could be going to school or working TO PAY YOUR BILLS YOU DON'T PAYYYYYYYYY loserssssssssss

they took money outta my account with my permission to pay my defaulted school loan and i just found out that the gov never recieved 1payment.
i see that someone wrote that they tried to pay there student loan and tx gov wouldnt give them a payment plan. that is too funny because i have talked to a girl at windham professionals and she told me she was collecting for my defaulted school loan. And i was more than willing to make automatic payments to be taken from my bank account. So i thought all was worked out and the payments were being taken out and i kept getting other collection agencies for them saying that i wasnt making payments. it seemed every month i was going through this. i had to keep calling and explaining i had the withdrawl amount paper from my bank in front of me. i just recently(today)got a letter from the comm of Mass telling me im in default and i explained that this happens every month and the man said that he doesnt know who i have been dealing with but this entire time iv been making payments towards my no interest loan that not one time did it show on there records. so i immediately called my bank and told them to cease all automatic withdrawls from them and ill be coming in to close and reopen another bank account. The lady i spoke with(at windham professionals) seemed so nice and professional one minute and the next she had to get off the phone asap. pretty much hanging up on me. Things were extremely weird everytime i got a phone call or called, it seemed she had 2 personalities. but i havent ever been scammed like that and i didnt believe i could be and im on ssi/disabled and i cant afford to be paying people that i dont owe. im so upset with myself but how was i suppose to know.

On 12/01/09, my mother, Luz G. Malaret received a call from this collection agencie at 10:00 PM (Fair Debt Collection Practices Act (FDCPA) states that a debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it). It was a restricted call from “Windham Professionals” by a lady called Terry Waltson (Tel: 888-241-8262 Ext. 7560). It is nearly impossible for Terry to have communicated anything my mother could of have completely comprehended in a manner she could understand due to the language barrier, only causing her to be confused, scared, and fearful. My mother does not speak or understand English very well and she was coerced into taking out a loan to make this payment. Terry used illegal scare tactics that involved legal threats to freeze assets, seize property, inquiry to finances, property ownerships, and mediated ways for my mother to pay off this debt regardless of her financial means within a set deadline for a set consequence. She told my mother that if she did not call her back to pay by 2 PM the next day she would understand that she did not want to pay and send it to legal so they could freeze her assets. My mother under the pressure and fear of getting all her assets frozen and therefore losing her job since she works for a bank went ahead and took a loan out to pay for the debt in total.
On 12/02/09, I spoke with Terry and I asked her why she called my mother instead of me. She first indicated that she called me and I told her I didn’t have any voice mails from her agency also that the only “weird Calls” I’ve been getting are always around 6 AM and I don’t pick up the phone at that time. She indicated that even if she hadn’t called me she could call my mother directly without contacting me first. I told her there is no way my mother can afford to make that payment to the bank and requested her money sent back to her and a payment plan be set up directly with me. She said in a very rude tone “Pay your mother back (a couple of times), we can’t return her money”.
After reviewing the Fair Debt Collection Practices Act (FDCPA) I have come to the conclusion that the following FDCPA regulations have been broken and are illegal actions taken by “Windham Professionals” Collectors:
A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they’re told (orally or in writing) that you’re not allowed to get calls there.
If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney. (Even thought Luz Malaret is the cosigner for this loan, I was never contacted and there was no intent of noticing me about these actions)
Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ( I was never made aware that my loan was sent to a collection agency and neither was Luz Malaret.)
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
• use threats of violence or harm;
• repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
• falsely claim that they have a way to freeze your assets;
Debt collectors also are prohibited from saying that:
• they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
• Legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
• try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge; (the loan was for less than $8, 000 USD but they charged Luz for $10, 326.50)
• take or threaten to take your property unless it can be done legally.
To resolve this matter, they need to return discussions of alternatives.
