Online Order For Acai Berry
This is in regards to the Acai Berry Scam with XM Brands. First of all I never recieved the product, they charged my account $87 and when I called to tell them I never recieved the product, they said the item was sent back and my account cancelled and they would refund my money. I thought GREAT! Untill I opened the email they sent me with the directions on how to obtain my email and they are charging me a 45% restocking fee! Not only was I upset about this, but the link they provided me for obtaining the refund does not work. I called them back after having several numbers that did not work. The working number I finally obtaind to first contact them was the number my bank gave me from the original charge. I argued the 45% restocking fee. They do not seem to understand I did not ever get a product to try and that I could not follow the time limit they have on a full refund because I never got the product! So she sent me a second email with the correct link...still does not work. So I thought I would send them an email with my complaints and frustrations. Guess what...the email does not work! So I found a email on this site...hope it works. I called them a 3rd time and tried to get a working email or address or something and they keep mysteriously being "disconnected" I am so frustrated! Any suggestions?

Telemarketing phone calls
I have been receiving telemarketing phone calls on my cell since cancelling my free trial order with XM Brands. Through reverse look-ups and research on the internet I've learned that most people who have received phone calls have also commented that they've ordered either teeth whiteners, diet supplements, acai berry etc for a free trial and have also cancelled their orders. If you've noticed that you to are receiving solicting phone calls you need to call XM Brands customer service department to delete your personal info.
Print out their Privacy policy. In their policy is does state that they will transfer your info to third parties and parties within the company. However, it also states that you are given 2 options.
1. You can opt out on the transfer or selling of your personal information. Remind them that their policy states that it will honor your request.
2. You have access to your personal information that allows you the option to ammend, correct, or DELETE your information.
Register your numbers home and cell on the "Do not call" registery and remind them that calling your cell phone is acting against FTC regulations and therefore illegal. Besides calling your cell phone is illegal period.
The representative tried running around the bush with my request, until I started reading their Privacy Policy. Mention section 3.3 and especially the part were you have access to delete your info. She eventually saw things my way. Remind them you will be sending a letter to its owner Kenneth Jacobi and its Director of Operations Todd Nechtman that you had this specific conversation with her.
I haven't received a phone call for a week so far. I hope this works.

unauthorized charge on my credit card
I ordered their product online for a "free" trial period a few months ago.
I received the trial product and took it for several days. Nothing changed. I didn't lose a pound using the product. I quit taking them, but forgot to read the very fine and lengthy print below the ads which stated that I would be charged $69 for the pills if I did not cancel my account with 21 days. I recently got a charge of $87.47 on my VISA card, which the bank thought was a fraudulent charge and called me about it. I have called the company at 888-879-9668, and spoken to two representatives. They both said that I received the product, so I have to pay for it. I think I was stupid for not reading the fine print before ordering, but this is just short of false advertising.
And, trying to find the USHealthNews anywhere (Julia recommended it after trying it for several weeks) on the internet is virtually impossible. I'd like to send HER my opinion of this product!
What a ripoff!!

Cancellation of order
I am now getting the RCMP involved as they have hung up on me every time I try to speak to a supervisor concerning my wanting to cancel the order within 24 hours of ordering. The policy link did not come up on the screen before I had confirmed order.
Once I reviewed the policy, I immediatly contacted them to cancel and they told me this was not a valid reason for cancelling as I HAD NOT TRIED THE PRODUCT.

******HERE IS HOW TO PROTECT YOURSELF AND YOUR MONEY******
-RECORD ALL CONVERSATIONS OF YOU CANCELING!!!very important! Make SURE you have that evidence. Call from a cellphone, they almost ALWAYS have a record option. Sometimes you have to wait until you dial the number. DON'T WAIT for them to pick up to start recording! Try this out with your friends first to make sure you know how to do this record option quickly! Also, confirm the date and time you're calling with them. Ask them to repeat to verify that your account is CANCELED!
-ALSO DEMAND an rma number from them so you can write this number in HUGE letters on the outside of the package!! ALSO ask them to tell you themself personally WHICH address you are to send this back to. At the END of the conversation, after you've done all this, let them know you've recorded this conversation for your records, because you have seen MANY complaints of them charging your account AFTER canceling. NOW, ALSO record yourself telling them that you expect no more product at all to be sent, and if it is, let them know that you will neither pay for it nor pay to send the product back, AND UNDER UNITED STATES LAW, YOU MAY CONSIDER IT A GIFT FROM THE COMPANY!! Let them know that, and if they do send your account to collections, you will inform them of this too, and you have plenty of documentation to hand to your attorney.
WHEN YOU SEND THE USELESS PRODUCT BACK- be SURE to write the rma number HUGE on it. Also make sure the correct address the scammer gave you is prominently displayed. Take pictures of this at the post office. Also, pay to have it insured, and also pay to have delivery confirmation signature added. This will prevent the scammers for using any of these as an excuse to refuse refunds.
Give copies of your canceling and copies of photos to your bank, and let them know you have followed all company procedures to the letter, and that you want to make sure these criminals do not get back in to your account.
****if they direct you to a website, be sure to take screen shots of the form filled out BEFORE you press submit and AFTER. To do this, you need to press the prntscrn on your keyboard. Then go to your paint program, go up to edit, click paste. Then go up to file save as, and change the format to a jpeg. Do this for each screen shot u take. Now you have evidence of that as well. Also, print out any and all emails and hand to your bank as well.

A link at the bottom of the page directing you to another site does NOT qualify. Also, according to the law, a company MUST make it easy and quick for customers to cancel negative option memberships, and MUST provide an rma number if one is required to avoid being charged. XM BRANDS INC IS LEGENDARY FOR TRYING TO REFUSE YOUR RMA NUMBER TO BE REVEALED. FRAUD activities
DO NOT ORDER FROM THESE GUYS, THEY ARE A TOTAL SCAM. I order a free trial of their weight loss pills, when I got the product it was after the 7 day trial period, they went ahead and charged my credit card $87.47. I call to cancel the order and they indicated that they charged me because I did not cancel during my free trial period, but that I could go ahead and return product. Here is where the fraud is. THEY DONT TELL YOU THAT WHEN YOU CANCEL AND RETURN PRODUCT (WHICH YOU HAVE TO PAY), THEY WILL HOLD 45% RESTOCKING FEE.M THIS IS TOLD TO YOU AFTER THE FACT.
I AM DISPUTING THIS VIA MY BANK WHO HAS INDICATED THAT NO WHERE IN THEIR WEBSITE DO THEY DISCLOSE THE FACT THAT THEY WILL HOLD 45% OF YOUR MONEY IF YOU CANCEL WITH THEM. Fraud
I responded to a report on Yahoo... teeth whitening. Try our promotional offer, just pay shipping. Naive as I am I ordered the stuff using my credit card. Anyway I thought I simply cancel if the stuff does not work. However the stuff did not arrive until after the 2 week cancellation time. I did not realize that the clock starts ticking from the day I order. After all it is a promotional offer. If the stuff works, people will beat a path to their door...
Then canceling is a hassle too. Instead of canceling when I called them, I get a number and have to log in onto their web site...
And the Credit Card Company is NOT on your side either... So I had to cancel them too. Still I have to pay something like $80. Since I spend >20K on my credit card every year, I think I won this one.
HALLLOOO Bank of America, you chasing away your best customers, if you refund my money, I may forgive you.
There have been thieves all throughout human history, but today it is worse than ever. In the middle ages these people would have burned at the stake. These days scams like this are perfectly legal. According to my definition of right and wrong: If I think I have been ripped off... I have...
And I am not alone. High time, that there will be some laws passed in congress. Freedom does not mean you can scam other people.
It is probably a cultural thing. Almost everybody is lying, sceaming or stealing. You almost have to game the system yourself, or you end up last. Good people die in annonymity.
Our virtual reality shows are based on the culture of screwing somebody over. Thieves as long as they are rich are admired. Banks have made a science of it, to stay within the law but make as much money as they can never mind how dis-honorable they have to be.
We live in a country where the constitution is virtually genius, still too many things in this society go badly wrong.

unauthorized billing
Misleading teeth whitening web ad offering free trial offer with paid postage & handling. After signing up you receive an email stating you are now a member & will be receiving products monthly. I responded immediately to their email stating I did not want there membership or product, to cancel order and membership. 10 days later they billed my debit card 87.47 for products.

Fraudulent charge
Received mysterious $88.34 charge on my VISA for an "online order."
Called number on transaction line, 877-683-3080 and was re-routed to 800-440-4397.
(after 10 mins on hold) Spoke with representative from XM Brands who told me she had no record of such transaction, and suggested that I call the 800 number (above) as listed on the transaction. I called it again and it was re-routed (again) to XM Brands.
A quick online search revealed hundreds of complaints against XM Brands for fraudulent charges.
I was previously an XM Radio customer, but vowed to never (ever) do business with them again after my experience with cancelling a subcription. XM did an "automatic renewal" AFTER I cancelled my subscription by telephone, then refused to turn off the service until I paid my balance. I explained that my service was paid in full, in advance, so there was no balance owed. They again refused to cancel until I paid $17. I had already cancelled prior to the end of my contract. Now, several months later, they hit me with an $88 charge out of nowhere - and deny it over the phone.

scam
Ordered what I thought was a free trial offer...only pay for shipping. Realized company was not reputable. Cancelled withing 15 min. of purchase. Received cancellation number & was told I would not be charged for product. Visa was charged for trial plus $87.oo for product. I have contacted Visa & had charges removed multiple times but they say they can't cancel charges from company. We will now have to cancel Visas & have new ones sent. It's amazing that this company of frauds can't be stopped! Beware of any brands from XM Brands. they have multiple products from Everbrite teeth whitening to acaiberry diet supplements
