I have emailed the following letter to CNN, NBC and Fox News as well as an abbreviated version to Oprah's site (2000 characters max on there). Please do the same! Just go to the home pages and click the contact us links at the bottom of the page. Subject: NBC logo and quote being used by fraudulent scamming website - PLEASE READ!!!

Dear Sir/Madam:

I am writing today to inform you of a company, XM Labs, who is using the NBC logo and quote from you regarding Acai berries on their website. They advertise a risk free trial for $4.95 to try their product and give you ten days from the order placement to cancel your "membership" before you are charged - they say it will take several days to receive it. They never ship the trial product. I was charged $139.97 on the 11th day and when I called to inform them I had not even received my trial yet, all they can say is "you agreed to the terms" they were completely unhelpful, the first person I spoke to hung up on me and the second stayed on the line with me and cancelled my membership but was just as unhelpful in getting my money back until I could actually try the product. They gave me a USPS tracking # that shows it was only processed for shipment yesterday, the 11th day - this would be my first shipment under the membership agreement and not the free trial. There are MANY complaints about this company online (I should have googled, that was my error - no more buying online from unknown companies for me!) The company is supposedly based out of Hollywood, FL but the IP address is in the West Indies. There are other complaints I found online showing even when customers cancel within the 10 days they are charged anyway and the company claims the wrong account was cancelled and there is nothing they can do. My bank, fortunately, is going to reimburse me and do an investigation.

I don't know if they are worthy of a story but I am sure NBC does not want their logo (in essence implying that you are endorsing their product) on a site that is defrauding consumers on a daily basis for hundreds of $$.

I am keeping this short and sweet in hopes it will be read and acted upon. I will also be contacting ABC, CNN and Fox News whose logos and quotes are also on the website, as well as Dr. Oz, he is quoted on the site too and they use his likeness. I would be surprised if this is with his permission.
